By accessing and using OctaveTTS text-to-speech service, you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By accessing or using OctaveTTS (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and OctaveTTS.

2. Description of Service

OctaveTTS is an online text-to-speech service that allows users to convert written text into spoken audio. The Service may include free usage options with limited features and paid subscription plans with additional capabilities.

3. User Accounts

3.1. To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3. We reserve the right to disable any user account at any time if, in our opinion, you have failed to comply with these Terms.

4. Subscription and Payments

4.1. Some features of the Service may require a subscription. By subscribing to a paid plan, you agree to pay all fees associated with the plan you select.

4.2. Subscription fees are billed in advance on a recurring basis, depending on the billing cycle you select (monthly, annually, etc.). Unless otherwise stated, subscriptions automatically renew at the end of each billing period.

4.3. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

4.4. We reserve the right to change our subscription fees upon reasonable notice. Any price changes will apply to billing periods following the notice of change.

5. User Content

5.1. "User Content" refers to any text, audio, or other material you submit to the Service for processing, storage, or sharing.

5.2. You retain all rights to your User Content. By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, adapt, and publish your User Content solely for the purpose of providing and improving the Service.

5.3. You are solely responsible for your User Content and the consequences of submitting it to the Service. You represent and warrant that:

• You own or have the necessary rights to use and authorize us to use your User Content;
• Your User Content does not violate the rights of any third party, including intellectual property rights and privacy rights;
• Your User Content complies with these Terms and all applicable laws and regulations.

6. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law or regulation;
• Infringe upon the rights of others, including intellectual property rights;

7.1. The Service and its original content (excluding User Content), features, and functionality are owned by OctaveTTS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2. You may not duplicate, copy, or reuse any portion of the HTML/CSS, JavaScript, or visual design elements of the Service without express written permission from OctaveTTS.

8. Limitation of Liability

8.1. To the maximum extent permitted by law, OctaveTTS and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service;
• Unauthorized access, use, or alteration of your transmissions or content.

8.2. In no event shall our total liability to you for all claims exceed the amount you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the liability.

9. Disclaimer of Warranties

9.1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied.

9.2. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

9.3. We do not warrant that the results obtained from using the Service will be accurate or reliable, or that the quality of any products, services, information, or other material purchased or obtained through the Service will meet your expectations.

11. Termination

11.1. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

11.2. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the account settings.
